Terms and Conditions


Payment

  • All bookings require a £100 deposit to secure the date and for the equipment protection to ensure everything is collected as its left.
  • This deposit will be transferred back to the client the day after the hire as long as there are no damages.
  • The hire amount is due 3 days prior to your cinema date. 
  • Bookings will only be placed in the diary once a deposit has been received. We can not hold bookings without deposits. 
  • Travel & waiting time  charges for bookings maybe applicable. 



Deposit

  • The client agrees to be responsible for the maintenance and safe keeping of all equipment whilst in their care.
  • Due to the late collection of equipment My Garden Cinema will check all equipment the following day and advise the client of any concerns.
  • Any damage caused to the equipment whilst in the client’s care will be redeemed using the holding deposit, for rectification of the equipment. 
  • The client is responsible for providing the full cost of any equipment damaged in their possession. A full list of replacement costs can be provided by  My Garden Cinema on request. 



Delivery, Set-up & Take -down Access

  • The client is responsible to ensure the venue is accessible and ready for the installation and collection of the equipment at the agreed times of the hire period. 
  • The area My Garden Cinema will set up on needs to clear, clean and free from debris and any kind of animal faeces.
  • My Garden Cinema aim to have everything set-up within ninety minutes, but it will sometimes take longer depending on access to the venue, any bespoke aspects of the venue location, which package has been hired and any demonstration period.
  • Breakdown of the equipment usually takes around an hour however this may extend slightly due to dark conditions.
  • In addition to the above, the client must ensure ease of parking and access to the venue for unloading and loading of equipment. If the venue is in a residents parking zone the hirer must be able to provide My Garden Cinema with a visitors parking permit on arrival at the venue. Any restrictions must be reported to My Garden Cinema prior to booking.
  • The client must advise the company if the cinema will be placed on anything other than real grass. 
  • The Inflatable screen needs a footprint of 5 metres width x 8 metres in length, including viewing space.
  • The Pop up Cinema, with the gazebo, needs a footprint of 3 metres x 3 metres – with another 3 metres for projection / viewing space. 
  • The Pop up Cinema within the fully enclosed gazebo needs a footprint of 6 metres x 3 metres, although a smaller gazebo maybe used. Please ensure you have measured the garden correctly to ensure there is enough space to pitch. 
  • The client will forfeit the full cost of the hire if on the day restricted access prevents My Garden Cinema setting up and the hire proceeding.
  • Time & Travel charges for bookings maybe applicable. 


  • My Garden Cinema will endeavour to arrive at the location and set up as scheduled, however from time to time delays can occur that are beyond My Garden Cinema control or responsibility. We will of course contact the client as soon as possible to make aware of the delays and expected ETA.


My Garden Cinema Equipment

  • We will provide equipment in a safe, working and usable condition.
  • If the client is not satisfied with any aspect of the equipment, they should state at the time of set up .
  • Equipment will be deemed to be in good working order, except for any defects not detectable by reasonable examination.
  • The equipment is visually checked and tested at the hire location once the hire session has finished and re checked the following day in the daylight, Any damage (other than fair wear and tear) will be recorded and reported at the time. Repairs will then be made by My Garden Cinema and will be charged to the hirer.
  • If any of the equipment is lost or stolen during the hire period, or extensions thereof, My Garden Cinema will charge the client the price of the lost or stolen item/s and potentially any loss of earnings or existing hire’s that cannot proceed due to the loss of that equipment.
  • If any equipment should fail while on hire the client should advise My Garden Cinema by telephone as soon as possible. The client should not attempt to repair any equipment without My Garden Cinema permission.
  • If any equipment fails whilst on hire My Garden Cinema will do their best to supply a replacement. If the client is charging an entrance fee and the screening is delayed or cancelled due to equipment failure My Garden Cinema will not be held responsible for covering any compensation paid out by the clients to their guests.
  • My Garden Cinema reserve the right to impose additional charges at the end of the hire period if the equipment on hire is not available to collect at the agreed collection time.


Cancellation Policy

  • Cancellations within 7 days of the booked hire date will forfeit the £100 deposit. Cancellation due to weather is refunded at the company’s discretion. 
  • My Garden Cinema like all small businesses can be significantly affected by late cancellations, matters which are beyond our control or issues created by a customer or other 3rd party, therefore we reserve the right to charge cancellation fees in certain circumstances. That being said, we value the meaning of great customer service and will always apply a pragmatic approach when faced with such situations with the goal of reaching a mutually amicable outcome.


Weather

  • So, the great British weather...
  • My Garden Cinema are unable to guarantee against rain, winds or other conditions that will have an adverse effect on the hire.
  • As the main premise for the setup is 'outdoors' the hire is dependent on fair and good weather, therefore if on the day of the hire if persistent rain and/or strong winds are forecast we will contact you on the morning of the booked date to discuss what options are possible such as an alternative indoor venue, postpone to another available date, or use of the garden pods. As detailed in the Refunds policy, refunds due to weather are at the company’s discretion. 
  • There is of course the chance the weather can change through the day despite the forecast. Should the onset of rain or high winds become obvious, the client should contact My Garden Cinema advising of such changes, we will make an assessment and if satisfied safe to proceed will agree for the use of the cinema to go ahead as long as the client follows our instructions for keeping the garden cinema equipment dry. This is for the safety of all of your guests and yourself as well as protecting our equipment!
  • Should the weather worsen during your experience we would expect the client to contact My Garden Cinema without delay and switch off the equipment at the power source (internal sockets) and ensure any electrical equipment (projector, sound system etc) is safely (and without any risk to persons) moved clearly under cover such as the gazebo. In such circumstances it would be considered unsafe or permissible for the hire to continue and regrettably My Garden Cinema will not offer a refund.


Force Majeure

  • My Garden Cinema cannot accept responsibility or pay any compensation where the performance or prompt performance of the booking is prevented or affected by reason of circumstances which amount to “force majeure”.
  • Circumstances amounting to “force majeure” include any event which we could not, even with all due care, foresee or avoid.
  • Such circumstances include the destruction or damage of the location set for the booking (which cannot reasonably be remedied to a satisfactory standard before the start of your stay) through fire, flood, explosion, storm or other weather damage, break-in, criminal damage, riots or civil strife, industrial action, natural or nuclear disaster, fire, adverse weather conditions, war or threat of war, actual or threatened terrorist activity, epidemic and all similar situations beyond our control.
  • It is explicitly agreed that an event of "force majeure" suspends execution of the reciprocal obligations for My Garden Cinema and the client, and that each party shall pay expenses resulting therefrom. 


Safety

  • My Garden Cinema do not accept liability for any accidents, injury or damage that may occur whilst the equipment is on hire.
  • The equipment must be supervised at all times by a responsible person over the age of 18 (preferably the client).
  • It is the clients responsibility to ensure access to  two 13 Amp power socket within 45 metres of where the screen will be positioned.
  • My Garden Cinema will provide a RCD breaker plug, extension cables and advise on ways to safely provide power to the screening source.
  • My Garden Cinema will leave the set up as safe and hazard free as possible and advise the customer of any trailing leads to be aware of.
  • No food or drinks to be allowed on or near the My Garden Cinema equipment.
  • No smoking or barbecues allowed near the My Garden Cinema equipment.
  • My Garden Cinema like any business operator have a duty to observe safe working practices at all times.
  • Should My Garden Cinema observe or deem something unsafe they have the right to request changes or refuse to allow the hire to proceed. 


Consent and Permissions to Take or use photos

  • My Garden Cinema will always seek permission from the client to confirm its ok to use photos of the cinema . 
  • The client gives My Garden Cinema permission to take photos / video’s of the equipment in use, these may include the client and their guests.
  • The client has advised all guests attending photos maybe taken.
  • The client gives My Garden Cinema the rights to use and publish these in print and/or electronic media.
  • The client agrees that such images and/or recordings without restriction for any lawful purpose, including for example such purposes as publicity, illustration, advertising and web content.   
  • My Garden Cinema will  contact the client the  day after the hire to re confirm it is ok to use the images taken and forward them to the client for approval.


Insurance

  • My Garden Cinema are insured up to the value of £1 million. 


Disclaimer

  • Please note that all persons using the My Garden Cinema equipment do so at their own risk.
  • The person/organisation hiring the equipment will be responsible/liable for any damage or injury occurring from use or misuse of the equipment.
  • These guidelines are for the safety of all people using this equipment, and it is the sole responsibility of the client to ensure they are adhered to.
  • It is the clients responsibility to ensure that the venue they are showing a film has the appropriate licenses if applicable. 
  • My Garden Cinema take no responsibility for the content that is shown on their equipment, arrange or provide any licenses nor provide any content (movies, box-sets, games) and any copyright infringement that may occur and subsequent offences and legal action are solely the responsibility of the client.
  • My Garden Cinema welcome any discussion prior to any booking be agreed regarding any and all terms stated and expressed within this document.




Covid-19 Hire Policy Updates




In accordance with UK Government Guidance from March 2021

 

 

My Garden Cinema agrees that in line with Government guidance business activities should only take place where we can establish social distancing, safe systems of work, and suitable protection measures for customers/staff and good disinfecting procedures for equipment. 

 

My Garden Cinema ask that you have outside access to your garden. My Garden Cinema regularly sanitise hands and wear face coverings. My Garden Cinema will only need to touch your device / DVD and My Garden Cinema customers will need to touch only the remote control for the volume. My Garden Cinema will sanitise their hands before touching anything you also need to touch.

 

Deck Chair Bundle Hire:

All Blankets, Cushions and Deck Chairs will be sprayed with Smartsan V in between use of 2 households.

 

Following the government’s Spring 2021 Covid-19 4 step response, My Garden Cinema can continue to trade and is permitted to continue to working in two’s if required and are treated as ‘Trades People’. When handing over the cinema experience to the customer My Garden Cinema will talk to 1 member of the household. Trading standards has advised that if a structure has a roof and sides this is classed as ‘inside’ so our Pop up gazebo cinema is classed as indoors. 

 

Step 1

Step 3                                     My Garden Cinema Inflatable & ½ pop up cinema can be enjoyed by upto 30 people.

No earlier than 17.05.21      My Garden Cinema Enclosed pop up cinema experiences can be enjoyed by 2 household or the rule of 6.

 

Step 4                                     No Legal limits – ALL My Garden Cinema experiences can be enjoyed by any amount of people!

 Following this guidance My Garden Cinema are not able to accept any bookings that does not adhere to these guidelines. When you pay your full balance that is your confirmation you have read your terms and conditions of hire. If My Garden Cinema set up your experience and the government guidelines are not being followed the experience will not take place and My Garden Cinema will retain all monies paid.

 

The client must notify My Garden Cinema in advance of delivery if there are any members of the household who are waiting for a Covid-19 test results, Have been advised to self-isolate, have tested positive for Covid-19 or are presenting with symptoms in the run up to hire or during hire. My Garden Cinema will also notify the hirer if at any point any members of our household become unwell with any symptoms of Covid-19 and reserve the right to cancel the hire if this situation arises. This policy is in addition to the standard risk assessment and terms of hire which must be agreed to prior to hire.
